Terms of Use (EULA)

Effective Date: March 23, 2026

1. Agreement to Terms

By downloading, installing, or using CaloNote (the "App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

The App is distributed through the Apple App Store and Google Play Store. Your use is also subject to the applicable store's terms of service:

2. Eligibility

This App is intended for users aged 14 and above. We do not knowingly collect data from children under 14. If we become aware that a user is under 14, their account will be deleted immediately.

3. Service Description & Account

CaloNote is a server-based AI health service that provides food image analysis, nutritional tracking, and personalized health management. User data is stored on our servers and an account is required to use the service.

  • You must provide accurate and up-to-date information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
The Company may modify or discontinue parts or all of the service with prior notice to maintain service quality.
4. Subscriptions and Payments

CaloNote offers premium features through auto-renewable subscriptions ("Pro").

ItemDetails
BillingAll transactions are processed by the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
Auto-RenewalSubscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
CancellationYou can manage and cancel your subscription anytime through your App Store or Google Play account settings.
RefundsAll refund requests must be handled through the respective app store's support channels. The developer has no authority to issue refunds directly.
Price ChangesYou will be notified of any subscription price changes via email or in-app notice before they take effect.
Cancelling your subscription does not immediately terminate access — Pro features remain available until the end of the current billing period. Mid-period refunds are subject to the applicable store's refund policy.
5. Purchase Restoration

If you reinstall the App or switch devices within the same OS ecosystem (iOS to iOS, or Android to Android), you can restore your Pro status using the "Restore Purchase" button within the App.

Cross-platform restoration (e.g., iOS to Android) is not supported due to store policies.
6. Data Ownership & Responsibility

You retain full ownership of all data you input into the App (meal photos, health records, etc.). The Company processes your data in accordance with our Privacy Policy.

  • You are legally responsible for any content you upload to the service.
  • You must not upload content that infringes third-party copyrights, portrait rights, or other rights.
  • Upon account deletion, your data will be disposed of in accordance with the retention periods specified in our Privacy Policy.
7. Partner Integrations

If you choose to connect a partner service (e.g., gym, clinic), the partner's own terms of service and privacy policy will additionally apply. The Company is not responsible for the content or data handling practices of partner services.

8. Prohibited Uses

You agree not to:

  • Attempt to decompile, reverse engineer, or extract the source code of the App
  • Use the App for any illegal or unauthorized purpose
  • Distribute or modify the App without prior written consent from the developer
  • Interfere with or disrupt the normal operation of the service
  • Unauthorized use of another user's account or collection of personal information
  • Input false information to misuse the service
  • Use automated means (bots, scripts, etc.) to generate an abnormal volume of requests
  • Place excessive load on the service's servers or network, or circumvent API rate limits
  • Exploit bugs or vulnerabilities, or manipulate data to gain unfair advantages (cheating)
If any of the above violations are detected, the Company may immediately suspend or permanently ban the offending account without prior warning. The Company shall not be liable for any disadvantages arising from such actions.
9. Suspension & Termination

The Company may restrict or terminate your access without prior notice if you violate these Terms. You may delete your account at any time through the in-app settings.

Deleting your account does not automatically cancel your subscription. You must separately cancel your subscription through your app store account settings.
10. Limitation of Liability

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Company shall not be liable for:

  • Indirect, incidental, or consequential damages arising from use or inability to use the service
  • Data loss resulting from user negligence
  • The accuracy of AI analysis results — the service does not constitute medical diagnosis
  • Damages arising from use of partner services
  • Service interruptions due to force majeure events such as natural disasters or communication failures
CaloNote's nutritional analysis and health information are for reference purposes only and do not substitute professional medical diagnosis or advice. Always consult a qualified healthcare professional regarding your health condition.
11. Intellectual Property

All content within the service (logos, designs, software, AI models, etc.) is the intellectual property of the Company. You may not reproduce, distribute, or modify any such content without prior written consent from the Company.

12. Changes to These Terms

The Company may update these Terms from time to time. Material changes will be notified at least 30 days in advance; other changes at least 7 days in advance, via in-app notice or email. Continued use of the service after updated Terms take effect constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. In the event of a dispute, the parties will first attempt to resolve it through mutual consultation. If unresolved, disputes may be submitted to the competent court.
